Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the EduWorkshops website (eduworkshops.co.za) and the online exam revision workshops and related services (the "Services") offered by EduWorkshops ("EduWorkshops", "we", "us" or "our"). By booking a workshop or otherwise using our Services, you ("you" or "the User") agree to be bound by these Terms. If you do not agree, you may not use the Services.

These Terms are entered into in accordance with the laws of the Republic of South Africa, including but not limited to the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") and the Protection of Personal Information Act 4 of 2013 ("POPIA").

2. The Services

EduWorkshops offers online exam revision workshops for Grade 10–12 learners, delivered by teachers and facilitators via live online sessions. Workshop dates, times, subjects, pricing and access instructions are displayed on the relevant workshop listing at the time of booking.

We may from time to time change, suspend or discontinue any workshop or feature of the Services. Where a paid workshop is cancelled by us, clause 7 ("Cancellations by EduWorkshops") applies.

3. Bookings and payment

  • All bookings are subject to availability and to confirmation by us. A booking is only confirmed once payment has been received in full and you have received a booking confirmation email.
  • Prices are quoted in South African Rand (ZAR) and, where applicable, include VAT.
  • Payments are processed by third-party payment providers. You are responsible for ensuring that the payment details you provide are correct and that you are authorised to use the payment method.
  • If you are under the age of 18, you confirm that a parent or legal guardian has consented to the booking and to these Terms and will be responsible for payment.

4. Access to workshops

Joining details (such as a meeting link) will be sent to the email address provided at booking. You are responsible for:

  • providing a valid, monitored email address;
  • having a suitable internet connection and device to attend the session; and
  • joining the workshop at the scheduled time.

Failure to attend a workshop for which you have booked, for reasons within your control, does not entitle you to a refund (see clause 6).

5. Acceptable use

You agree that you will not:

  • share your booking, access link or workshop recording with any other person;
  • record, reproduce, distribute or publicly display any part of a workshop, its materials or the presenter's likeness without our prior written consent;
  • use the Services to transmit unlawful, harmful, threatening, abusive, harassing, defamatory or otherwise objectionable content; or
  • disrupt or interfere with a workshop or with other attendees.

We may remove any attendee from a workshop, and suspend or terminate access to the Services, for breach of this clause, without refund.

6. Refund and cancellation policy

6.1 Cooling-off (ECTA s. 44)

As a consumer who has entered into an electronic transaction, you are generally entitled to cancel the transaction without reason and without penalty within seven (7) days after the date of the transaction, in accordance with section 44 of ECTA. However, section 42(2) of ECTA excludes the cooling-off right in certain cases, including where the service has already begun to be performed with your consent before the end of the seven-day period.

Accordingly, if the workshop has already taken place, or has commenced, within the seven-day period, the cooling-off right no longer applies to that workshop.

6.2 Cancellations by you

  • More than 48 hours before the workshop start time: you may cancel for a full refund, or elect to move your booking to another scheduled workshop of equivalent value (subject to availability).
  • Between 48 and 24 hours before the workshop start time: you may move your booking to another scheduled workshop of equivalent value (subject to availability). Cash refunds are not available in this window.
  • Less than 24 hours before the workshop start time, or after the workshop has started: no refund or rebooking is available.
  • No-shows: failure to attend a workshop, without prior cancellation as set out above, is not refundable.

To request a cancellation or rebooking, contact us using the contact details on our website and include your booking confirmation reference. Approved refunds will be paid to the original payment method within a reasonable period (typically 5–10 business days), subject to processing times of the payment provider and bank.

6.3 Statutory rights preserved

Nothing in this policy limits any right you may have under the CPA, ECTA or other applicable law, including your right to a refund where a service is not performed, is performed in a manner or of a quality that is materially inconsistent with what a reasonable person would expect, or where we are otherwise in breach of these Terms.

7. Cancellations or changes by EduWorkshops

We may, for operational, technical or safety reasons, cancel, reschedule or change the presenter of a workshop. Where we cancel a workshop and are unable to offer a reasonable alternative, you will be entitled to a full refund of the amount paid for that workshop. Where we reschedule a workshop, you may elect to attend on the new date or receive a full refund.

We will not be liable for any indirect, consequential or incidental costs (such as data, travel or third-party subscriptions) arising from a cancellation or change.

8. Intellectual property

All content, materials, recordings, notes, worksheets, branding and software forming part of the Services are owned by or licensed to EduWorkshops and are protected by South African and international copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the materials solely for your personal, non-commercial study. Any other use is prohibited without our prior written consent.

9. Personal information (POPIA)

We process personal information in accordance with POPIA. We collect information such as name, email address, grade, subject preferences and payment details solely for the purpose of providing the Services, communicating with you about your bookings, and complying with legal obligations. You have the right to access, correct or request deletion of your personal information, subject to applicable retention obligations. 10. Disclaimer and educational outcomes

Our workshops are intended to support and supplement, not replace, the learner's school curriculum and study. While our facilitators use reasonable skill and care, EduWorkshops does not guarantee any particular academic result, mark or exam outcome.

11. Limitation of liability

To the maximum extent permitted by law, EduWorkshops, its directors, employees and facilitators will not be liable for any indirect, incidental, special or consequential loss or damage arising out of or in connection with the Services. Our total liability to you for any claim arising out of the Services will not exceed the amount actually paid by you for the specific workshop giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the CPA or other applicable law.

12. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date and will apply to bookings made after that date.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. The parties submit to the non-exclusive jurisdiction of the South African courts. Nothing in this clause limits your right to refer a dispute to the National Consumer Commission or any ombud or tribunal with jurisdiction under the CPA.
